Terms and Conditions
1. The acceptance of the booking is based on agreement by the client of the terms and conditions stated herein.
2. PAYMENT:
2.1 All photography sessions will be subject to a non refundable booking fee of £50 to secure your session date.
For newborn sessions only: Due to the uncertain prediction of an exact arrival day of your baby, certain flexibility for booking the newborn session will apply. An initial date within the first 10 days of your due date is to be pencil-booked in, however, this is subject to change depending on the exact date of birth.
2.2 The remainder of the price must be paid in full before or on the session day.
2.3 Once agreed upon a final session date, you may reschedule your session up to 7 days prior to your shoot if required. After this a £50.00 rebooking fee will be charged. Session fees are refundable up to one calendar month before your session date apart from the non refundable fee.
2.4 Photo packages that are on offer following the session are subject to a non refundable fee, the amount will be stipulated within the package pricing. Packages will be released upon receiving payment in full.
3. NEWBORN SESSIONS:
3.1 Newborn photo sessions must be completed whilst the baby is between 4 – 14 days of the birth. After this date the baby will be more aware of their surroundings and we can not guarantee the same quality of pictures/positioning. We understand that at times a session within this time frame is not possible due to various reasons and as such we will accommodate and make every effort possible to ensure the quality of picture is the same.
4. OUTDOOR SHOOTS
4.1 No refunds will be given, but we will endeavour to rearrange a reserve date in the event of awful weather. We do not guarantee exclusive use during sessions. However, we encourage you to make the most of any weather conditions, this is the great British summer so expect the unexpected! In the event of bad weather.
4.2 The number and maturity of the flowers are dependent on both the weather and how many we have sold, and as such can vary. We are primarily a PYO venue and absolutely cannot guarantee the number or condition of the flowers on your shoot date.
4.3 This is a field and as such we do not have any changing facilities.
4.4 Absolutely no smoking or vaping at any time.
4.5 Children and pets need to be supervised at all times. Courtney Jane Photography cannot be held responsible any incidents that occur.
5. PACKAGES:
5.1 All orders for packages must be paid before delivery of goods. Once goods are delivered no money is refundable unless items are damaged/defective. If items are damaged/defective every effort will be to provide you with new goods.
6. DELIVERY:
6.1 All images will be delivered via a download link or email attachments to the Client within 5-6 weeks of the session date. Delivery for prints, albums or any other additional orders may vary and will be advised at time of booking/when final images have been delivered.
7. COPYRIGHT:
7.1It is understood that the copyright of all and any photographs belongs to Courtney Jane Photography. No photographs may be copied or reproduced by any means photographic or otherwise by any person or machine other than by the photographer or her appointed agent, unless the pictures are purchased by the Client. Releasing photographs online by the Client (i.e. Facebook, blog or any other online channels) are prohibited unless the photographer’s company name, Facebook Page and/or Website is tagged or mentioned along with the image.
8. MODEL RELEASE:
8.1 The copyright of all photographs is owned by Courtney Jane Photography. We, the client, give permission to Courtney Jane Photography to use any image of our photo session for any general marketing and advertising purposes for Courtney Jane Photography. Courtney Jane Photography is entitled to use all images produced for i.e. exhibitions, editorials, digital and print marketing incl. social media platforms, publications, educational DVDs and websites, and/or display purposes.
9. STORAGE:
9.1 After 3 months from your session date Courtney Jane Photography will no longer be responsible for storing your image files.
10. MISC:
10.1Although the photographer shall exercise all reasonable skill, care and diligence in the discharge of her duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record, the photographer will only be responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs.
11. COVID 19
11.1 – To protect customers, Courtney Jane Photography reserves the right to cancel or postpone any pre-booked photography service should it be deemed to have risk of transferring the COVID-19 virus. The cancellation would result in any pre-paid monies being returned to the customer. The cancellation or postponement cannot result in the customer seeking any compensation from Courtney Jane Photography.
11.2 – The customer should contact Courtney Jane Photography if they have symptoms of COVID-19 or could be deemed at higher risk of having the virus due to their environmental situation.
11.3 – The customer should not attend any photography shoot if they have a high risk of having or carrying COVID-19.
11.4 – If the session is at the customers home, all precautions relating to COVID-19 must be adhered to. These are but not limited to, minimal persons in the house, open windows and doors to allow adequate ventilation, regularly wash or sanitise hands, and wear appropriate face coverings when not in front of the camera.
11.4 – Courtney Jane Photography services will change in compliance with Government updates, policies and guidelines.
11.5 – Courtney Jane Photography cannot be held liable for any actions relating to the spread of COVID-19, which are out-with her control or attempts to minimise the risk.
11.6 – Courtney Jane Photography cannot be held liable for any failure by venues or person to practice risk reduction strategies relating to minimising risk of transfer of COVID-19.
